Annual leave
Under the Labour Act, 2003 (Act 651), every worker is entitled to at least fifteen working days of leave with full pay in a calendar year of continuous service. Public holidays and sick days do not count against it, and an agreement to forgo leave for cash is void — the time off itself is the right.
Most employers accrue it monthly (1.25 days per month worked), which is exactly how Nobicel tracks balances for each employee.
Sick leave
Days certified by a medical practitioner are treated separately from annual leave. Keep the certificate on the employee’s record; Nobicel stores it against the request so the audit trail is complete.
Maternity leave
Expectant mothers are entitled to at least twelve weeks of maternity leave with full pay, extendable by two additional weeks in cases such as caesarean delivery or multiple births. On return, nursing mothers are entitled to daily nursing breaks. Dismissal because of pregnancy or maternity absence is unlawful.
Rest, hours and notice
These floors apply regardless of what a contract says — contracts can improve on them, never reduce them.
- Maximum standard hours: 8 per day / 40 per week, with overtime by agreement
- Daily rest of at least 12 continuous hours, and 48 continuous hours weekly
- Termination notice: from 2 weeks (under 3 years’ service) to 1 month (3+ years), or pay in lieu
